3 Things To Avoid While Fighting A Custody Battle

If you are fighting a custody battle there is a good chance you are worried that you are going to lose your kids. Every day the courts have to determine who is fit to have custody and they use a system to make that decision. If you are trying to prove that you deserve custody of your children, here are a couple things you should avoid doing.

1. Talking Badly About Your Ex-Spouse

Don't fall into the trap of thinking that if you talk badly about your spouse that it will improve your chances of getting your children. A custody battle is not like a sporting event. There is not one team that will win; it is just a matter of getting the other team to lose. If the courts don't think that either of you are fit to be parents, they will grant custody of the child to an entirely different party.

This is why it is important that you make sure that you are proving why you deserve custody of the children. By making the other parent look bad, you show that you are immature and are not fit to care for the emotional needs of your children.

2. Being Charged With A Crime

Another problem is having a criminal record. The courts want to ensure that your children are safe in your presence. Obviously, any accounts of domestic violence will reflect poorly on your ability to get your children. But most people do not recognize that you can hurt your chances by having any kind of  criminal record. If you are caught in possession of drugs, a DUI, assault, and so forth, it could hurt your chances. You need to prove that you are fit to be a parent, so make sure you stay away from trouble with the law.

3. Become Unemployed

The courts want to see that you are not only emotionally able to care for the child, they also need to insure that you can care for their physical and financial well-being as well. Losing your job and having a short period of unemployment is understandable. However, if you are constantly moving from job to job, or having long periods of unemployment, you might lose custody of the children. This is why it is important to do whatever you can to get some sort of steady employment.
